STEP-BY-STEP PROCESS:
Commercial Eviction Proceedings are NOT governed by the Prevention of Illegal Eviction from and Unlawful Occupation of Property Act (“PIE Act”) and accordingly, the steps are as follows:

The eviction application will be issued at the appropriate court and a hearing date will be obtained on which the eviction application will be heard;

The eviction application will be served by the sheriff on the unlawful occupiers;

The court file will be indexed and paginated, ready for hearing before a magistrate in open court;

If the eviction is opposed, a few additional steps will be taken;

Lastly, an experienced attorney will argue your case to obtain an eviction order.
