STEP-BY-STEP PROCESS:

The Prevention of Illegal Eviction from and Unlawful Occupation of Property Act (“PIE Act”) governs this process.

  1. We will first consult with you and gather all the necessary information/documentation;

  2. We will draft both the Eviction application and the Section 4(2) Ex Parte application;

  3. The eviction application will be issued at the appropriate court and a hearing date will be obtained on which the eviction application will be heard;

  4. The eviction application will be served by the sheriff on the unlawful occupiers;

  5. Once we receive the return of service from the sheriff, an experienced attorney will approach a Magistrate in chambers to award the section 4(2) Ex Parte application, granting us permission to continue with the eviction process (this court order confirms that the eviction application is compliant with the PIE ACT and the Constitution);

  6. The section 4(2) court order together with the eviction application will be served by the sheriff on the unlawful occupiers;

  7. The court file will be indexed and paginated, ready for hearing before a magistrate in open court;

  8. If the eviction is opposed, a few additional steps will be taken;

  9. Lastly, an experienced attorney will argue your case to obtain an eviction order.

WHY MUST I EVICT AN UNLAWFUL OCCUPIER?

An eviction order is the only lawful manner in which an unlawful occupier may be forcefully removed from a property.

It is important for a landlord/landowner to use the procedure provided for in the PIE Act, rather than taking the law into his/her own hands, for example, cutting the electricity and water supply to the property or intimidating the unlawful occupier, in the hope that s/he will vacate the property. These actions are illegal and the tenant could obtain a spoliation order against the landlord which could become an unnecessarily costly mistake.
