During the transfer process, we, as the transfer attorneys (also known as the conveyancers), are required to submit original documentation to the Deeds Office. When the documents are signed outside of the country, these need to be notarized and authenticated in the country where the documents are signed. This comes at a cost and can cause delays in the transfer process as it requires an attorney to effect the notarization and authentication. Furthermore, these original documents then to be sent via courier to us in order to submit the original documents to the Deeds Office.
If you plan ahead for this eventuality, this process can be avoided. We will draft a Power of Attorney which gives authority to somebody in South Africa to sign the documents on your behalf. You can either give one of our Attorneys authority to sign on your behalf, or you can give such authority to a trusted family member or friend.
This Power of Attorney will authorize the elected person to sign the documents required for transfer but will not authorize the person to sell the property themselves. You will still sign the sale agreement as this does not need to be an original and does not need to be signed in South Africa. You can thus rest assured that your property will not be transferred by your authorized signatory. Only once you have signed and agreed to the sale of your property, will your authorized signatory obtain the authority to sign the further documents.
